IMPORTANT NOTICE: THESE TERMS AND CONDITIONS ARE A BINDING LEGAL CONTRACT BETWEEN YOU AND CONTRA COSTA HEALTH. BY ACCESSING OR USING THE MyChart SYSTEM, RELATED SERVICES, AND ANY MATERIALS AND DATA MADE AVAILABLE THROUGH THEM (COLLECTIVELY, THE “MyChart”), YOU (A) AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS; AND (B) ACKNOWLEDGE AND AGREE YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF USING MyChart AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS EXPRESSLY PROVIDED IN THESE TERMS AND CONDITIONS. IN ADDITION, IF YOU ARE ACCEPTING THESE TERMS AND CONDITIONS ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, THEN YOU REPRESENT AND WARRANT THAT YOU ARE AUTHORIZED AND LAWFULLY ABLE TO BIND THAT COMPANY OR ENTITY TO THESE TERMS AND CONDITIONS. YOU SHOULD PRINT AND RETAIN A COPY OF THESE TERMS AND CONDITIONS FOR YOUR RECORDS BY USING THE PRINT FUNCTIONALITY IN YOUR BROWSER. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT USE MyChart.


LICENSE

We grant you a non-exclusive, non-transferable license to access and use MyChart solely for your internal use and at all times consistent with the requirements of these Terms and Conditions. MyChart is provided as a convenience to you, access may be revoked or suspended at any time, without cause or prior notice. MyChart is the property of Contra Costa Health and/or its subsidiaries, affiliates, vendors, and licensors. All MyChart information and the logos, icons and other marks shown or referenced within are reserved by Contra Costa Health and are protected by copyright and trademark law. The user may not reproduce such information without the prior written consent of Contra Costa Health. You may not use automated systems (e.g., robots, spiders, etc.) to access and use MyChart. Any rights not expressly granted by these Terms and Conditions are reserved by Contra Costa Health and/or its vendors and licensors. You may not attempt to reverse engineer, decompile, or otherwise seek to discover the source code for MyChart.


TRADEMARKS

Contra Costa Health, Contra Costa Health & Design are trademarks and service marks of Contra Costa Health (CCH) (collectively, CCH Marks). All other trademarks or service marks are the property of their respective owners in the United States and other countries. The CCH Marks must be used in accordance with the CCH’s trademark guidelines, may not be used in connection with any product or service other than those of CCH, and may not be used in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits CCH or the Site. You gain no right to use any CCH Marks or those of any other entity by virtue of your use of this Site.


LINKS OR POINTERS TO OTHER SITES

We make no representations whatsoever about any other Web site that you may access through MyChart. When you access a non-Contra Costa Health site, please understand that it is independent from us, and that we have no control over the content on that Web site. In addition, a hyperlink to another Web site does not mean that we endorse or accept any responsibility for the content, or the use, of the linked site. It is up to you to take precautions to ensure that whatever you select for your use or download is free of such items as viruses, worms, Trojan horses, and other items of a destructive nature. If you decide to access any of the third party sites, you do this entirely at your own sole risk. you should not rely on any of the information found on those sites for purposes of treatment or diagnosis.


DISCLAIMERS; MEDICAL INFORMATION

The information on MyChart is meant for use only to support the patient's relationship with their current or future health care provider. Your reliance on the material in MyChart is at your own risk. Please note the medical or health care information provided on MyChart is not a replacement for proper medical attention. Your electronic record is the property of Contra Costa Health, and the information displayed in MyChart is not your complete medical record. Contact the clinic where you received services for official copies of your medical record, or if you believe there is a discrepancy with the medical information listed in your record.


USE OF MyChart

You should NEVER use MyChart for urgent health care matters. The anticipated turnaround time for a response to a secure message is three business days. If you are suffering from an urgent or life threatening health condition, call 911 or go to the nearest hospital emergency room.

At this time, we anticipate that the MyChart web portal will provide the following services:


  • Ability to review, make, or cancel appointments
  • Ability to view selected portions of your medical record such as allergies, medications, histories, your medical problems list, and recent visit information
  • Ability to receive selected lab results
  • Communicate with your physician via secure messaging regarding health concerns
  • Request prescription refills
  • Links to other sites that will provide you with health information

The foregoing, however, are subject to change at any time, without prior notice.


REVISIONS, CHANGES, AND UPDATES

We may revise, remove functionality, and otherwise evolve MyChart as we deem appropriate or discontinue MyChart in its entirety, all without prior notice. Contra Costa Health may also make improvements and/or changes in products and/or services described in MyChart or add new features at any time without notice.


SECURITY AND CONFIDENTIALITY

Contra Costa Health places considerable emphasis on the privacy of patient information and our compliance with State and Federal Privacy Laws. Although MyChart is configured to be secure from unauthorized access, Contra Costa Health cannot be held responsible for:


  • Absolute security of all electronic communication transmissions between patient and clinic;
  • Unauthorized disclosure resulting from a user not logging out of an active session;
  • Unauthorized disclosure resulting from a lost or stolen User ID and password;
  • Unauthorized disclosure resulting from information printed by the user from MyChart;
  • Unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or
  • Similar events outside the substantial control of the Contra Costa Health. Contra Costa Health is committed to protecting the confidentiality of your medical information. We limit employee access and ability to enter or view information based upon their role in your care. Our employees are subject to strict standards on maintaining your confidentiality. By allowing you access to your medical information, you must share this responsibility.

Contra Costa Health has taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. We afford the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored by Contra Costa Health in any other medium. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. Contra Costa Health shall identify the records released and note the time and date of access each time you access MyChart. You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a MyChart user, your role in maintaining the security of your medical information is to: 1) change your password on a regular basis, and 2) keep your User ID and password confidential. Additional features include:


  • Session Timeout: After a period of inactivity, the logon session will time out.
  • Monitoring: We constantly monitor the web server for evidence of unauthorized break-in attempts. We apply the latest security patches as they become available.

ACCESS, CORRECTION AND DATA INTEGRITY

Although we attempt to maintain the integrity and accuracy of the information on the website, we make no guarantees as to its correctness, completeness, or accuracy. The website may contain typographical errors, inaccuracies, or other errors or omissions. Unauthorized additions, deletions, or alterations could be made to the website by third parties without our knowledge. If you believe that information found on the website is inaccurate or unauthorized, or if you are having technical problems when you try to access your MyChart account, you can call the Help Desk at 1-844-622-5465.

MyChart does not contain your complete medical record. It is only a summary of your record. If you would like to see your complete record please contact the Medical Records Department at your health center. If you believe the information in your MyChart health record is not correct, contact your provider or the Medical Records Department at the location where you received services.


E-MAIL PRIVACY

As a user of MyChart, you will be notified via e-mail when there is new medical information to be viewed. Contra Costa Health is only able to respond to electronic communications based on the information provided by you, the patient. If there is insufficient information provided, Contra Costa Health will be unable to provide accurate and reliable services. This also means that any person with access to your e-mail will be able to see this notification. This could include your family members, employer, or anyone else who can access your e-mail account. Although no private medical information will be sent via e-mail, the notification that new medical information is available by accessing MyChart may be information that you would not want others to know. Thus, you should take this into account when providing an e-mail address or using MyChart.


RESPONSE TO ELECTRONIC COMMUNICATION

If you send us an e-mail communication, it may be accessed or shared with the clinical staff that assists the physician in providing your medical care. Your confidential medical information on MyChart will be accessible only to appropriate Contra Costa Health staff.

Contra Costa Health will use reasonable efforts to provide a timely response to electronic inquiries or other communication submitted through MyChart. In some cases, Contra Costa Health staff may not be immediately available, so you should allow at least two (2) business days for a response. If you require a quicker response, please call your health care provider. Emergency situations requiring immediate attention should not be submitted electronically.


PERSONAL IDENTIFICATION CODE AND PASSWORD

You will be given a unique 15-digit access code by Contra Costa Health to allow you access to MyChart. The first time you log into MyChart, you will be required to create a unique six character User ID and a six-character password. You agree to keep your User ID and password confidential. Anyone with access to your User ID and password would have access to your personal health information, the ability to add to your personal health information, and the ability to send messages to your providers as if they were you. It is your responsibility to change your password if you believe it has been compromised or shared with someone else. It is recommended that you change your password every 180 days. Every time you log into MyChart, your User ID and password will be logged in an audit trail in the computer system. You are responsible for ensuring the security of your user name and password and all transactions and activities made using them. Store them in a secure place.

If Contra Costa Health discovers that you have inappropriately shared your password or that you have abused your access privileges, we may terminate your participation in MyChart. Contra Costa Health takes no responsibility for, and disclaims any and all liability for, damages arising from a breach of medical record confidentiality resulting from your sharing or losing your password.


APPROPRIATE USE

Access to the MyChart system is granted to users for the purpose of facilitating their medical care. Use of the system unrelated to this purpose may result in the suspension or termination of access privileges.

You agree that you will not upload or transmit any communications or content of any type (including secure messaging) that may infringe upon, misappropriate, or violate any rights of any party.

You agree that the following actions shall constitute a material breach of these Terms and Conditions, resulting in immediate termination of access to MyChart:


  • the use of inappropriate or abusive language
  • reserving appointment times that are not needed or are frequently cancelled
  • other activities that are deemed to cause a disruption to clinic operations
  • signing on as, or pretending to be another person
  • transmitting messages or material that infringes on, or violates, the intellectual property rights of others, or the privacy or publicity rights of others
  • transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including Contra Costa Health personnel) or entity
  • using MyChart’s interactive services in any way that is intended or is reasonably likely to harm the patient or others or that would disrupt operation of MyChart
  • collecting information about others, including e-mail addresses
  • intentionally distributing viruses or other harmful computer code
  • use of MyChart in any way that could expose Contra Costa Health to liability

Contra Costa Health expressly reserves the right, in its sole discretion, to terminate, without prior notice, a user's access to any interactive services and/or to any or all other areas of MyChart due to any act that would constitute a violation of these Terms and Conditions. You will be notified by e-mail and you will be sent a deactivation letter by U.S. mail if we discontinue your MyChart access.


DISCLAIMER

MyChart, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED “AS-AVAILABLE” AND “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, QUALITY OF INFORMATION, AND TITLE/NONINFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF MyChart, SITE-RELATED SERVICES AND DATA, AND HYPERLINKED WEB SITES. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY CONTRA COSTA HEALTH OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY. YOU UNDERSTAND AND AGREE THAT WE DO NOT OPERATE OR CONTROL THE INTERNET AND THAT: (I) VIRUSES, WORMS, TROJAN HORSES, OR OTHER UNDESIRABLE DATA OR SOFTWARE; OR (II) UNAUTHORIZED THIRD PARTIES (e.g., HACKERS) MAY ATTEMPT TO OBTAIN ACCESS TO AND DAMAGE YOUR DATA, COMPUTERS, OR NETWORKS. WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY SUCH ACTIVITIES.


OTHER TERMS

CONTRA COSTA COUNTY, CONTRA COSTA HEALTH, AND ITS AFFILIATES, VENDORS, AND LICENSORS ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO MyChart, SITE-RELATED SERVICES AND PRODUCTS, CONTENT OR INFORMATION CONTAINED WITHIN THEM, AND/OR ANY HYPERLINKED WEB SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH MyChart, SITE-RELATED SERVICES, AND/OR HYPERLINKED WEB SITES IS TO STOP USING THEM. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

These terms and conditions are governed by California law without regard to its principles of conflicts of law. Any dispute, controversy or claim arising under, out of, in connection with or in relation to the Site or these Terms and Conditions will be resolved in the County of Contra Costa, California. In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.

Contra Costa Health cannot guarantee access to the MyChart system, and is not liable for your inability to access or view the information contained on the site. By using MyChart, you agree to defend, indemnify, and hold harmless Contra Costa County, Contra Costa Health, and its employees, officers, agents, affiliates, vendors, and licensors from against any damages, liabilities, fines, claims, or other claims asserted against them arising out of, or in any way connected with, your use of MyChart or the information contained therein.

This Agreement contains the entire agreement between the parties with respect to the subject matter contained herein. The terms of this Agreement may be changed at any time by the discretion of Contra Costa Health, and the updated terms will be posted on the MyChart website for user access. We encourage you to periodically read these Terms and Conditions to see if there have been any changes to our policies that may affect you. Your continued use of the website will signify your continued agreement to these Terms and Conditions as they may be revised.
